| In 2005, the Accident Compensation Act changed from Medical Misadventure to Treatment Injury in order to shift from a focus on medical error to one of the client and their needs. ACC receives approximately 10,000 claims for treatment injury per year of which over 60% are accepted for cover. Whilst the primary focus of the Treatment Injury Centre is determining cover for treatment injury claims, an ancillary role is to report any reasonable belief of risk of harm that becomes apparent in the course of claim assessment. Usually this involves reporting the facility to the Director General of Health but when peer review has been critical of the standard of treatment, the individual may be reported to their registration authority. This presentation will include a number of interesting case studies which will assist the audience to understand treatment injury and provide ‘food for thought’ that may be applied to clinical practice.
